    One of the two men sentenced for the death of gas station operator, Lloyd G. Brown and his fiancee five years ago, has been freed.
    42-year-old Donald Whyte, a labourer of a Kingston address was acquitted when he appeared in the court of Appeal this morning.
    He had been ordered to serve life imprisonment in 2007.

    Defense lawyer, Ian Wilkinson submitted in court this morning that White should have been freed at his trial after a no case submission was made.

    He said there was no evidence to link him to the double murder.

    Director of Public Prosecutions, Paula Llwelyn agreed and then ordered that he be freed.
    The other murder convict, 41-year-old Peter Dougal, a construction worker and farmer of Santoy district in Hanover is scheduled to appear in court next Monday.
    He had been sentenced to hang.
    However, Dougal’s attorneys raised issues in relation to the death penalty and that appeal is to be heard by a special panel of judges.
    62-year-old Lloyd G. Brown, and his 49-year-old fiancée, Sandra Campbell were shot dead at Campbell's Stillwell Road residence in Stony Hill, St. Andrew, about 4:00 a.m. on June 6, 2004.
    Evidence was given that within hours of the double murder, police personnel went to Vineyard Town where Dougal and a group of men engaged them in a shoot-out.
    During the incident, Dougal was shot and the murder weapon taken from him.
    He was also found in possession of Brown's photograph.
