      daz why a yuh a de counselor... therefore, except in the case of a procedural breach as in the case of brooks, the other four would have to either submit a guilty plea or found guilty of taking the substance that generated an adverse analytic finding, since that substance was found to be in their system... from what i gather from you, guilty is guilty by any standard...

      therefore, it appears the most important part is the hearing to determine whether they deliberately intended to gain an advantage by using this substance and the resulting punishment that goes with the finding...

        They plead guilty as there was no choice. Strict liability applies and the drug was in the body.

        All that is relevant now is the explanation of HOW it got there, intentionally or accidentally. That determines the severity of the punishment.

          Intentional or not is irrelevant to guilt under strict liability. That only applied to the sentence.
