    MICHAEL STERN, the Jamaica Labour Party (JLP) Member of Parliament for North West Clarendon, was today disqualified in the Supreme Court.

    The JLP and the People's National Party, who filed the petition against Stern, are now making submissions as to whether the seat should be handed to the opposition or a by-election ordered, as was the precedent in two previous cases. The PNP's Richard Azan had filed a petition that Stern was ineligble to sit in the house because he had United States citizenship.

    The opposition has brought two successful court actions over dual citizenship against JLP MPs in 2008, but the subsequent by-elections.

    Another PNP petition is pending against Shahine Robinson, JLP MP for North East St Ann.

    cannot see under what circumstances it will not be a by election...the precedent is set and i cannot see the jlp voluntarily giving up a seat.

      This was a given, that he admitted publicly that he was a US citizen when he was nominated.

        Based on the news today seems BOTH parties are tired of the by-elections and want to be rid of them and the cost to the country and have been in meetings.

        From where i sit it seems the one in St Ann could be aborted for want of a better word but this one appeared to have gone too far to stop.

        But the spoke in the wheel is that the PNP said is not the caretaker anymore....hmmmmm

                Since the man get disqualified, here comes annedda by election. So all the comrade MPs dem ongle have citizenship from Ja then...

                  No. They should give up the seat and a by-election should take place. That is what the courts have ruled

                    Stern has admitted to gaining his United States citizenship through a friend who had filed for him and his family.
                    I will go as far as to say that is a ************************ lie! If friends can file for friends and their families, Jamaica would be empty!

                      He could be telling the truth but friend must have filed for him for work related purposes using the H1B to Green Card route.
                      The same type of thinking that created a problem cannot be used to solve the problem.

                          The below was heard...cannot vouch for it...or can I?

                          ...or it could be his friend filled the forms as he used that "little known" - (Could be "little known" as nutten nuh guh suh?) - route of "investing a certain sum" in the good ole USA.

                          I think in the '60s it was as low as US$40,000.00/45,000.00?

                          I think now it is somewhere about US$145,000.00? Not sure it could be much higher.

                            I think it is about $500,000 now...I had reason to be reading the rules a few years ago and came across it or maybe was told by some one.

                            If you have that amount in a US bank account and can show proof it would not be taken out right afterwards, the cirizenship process can be speeded up
